Magisterial District Court Report

Matthew Nicholas Tirpak, 18, 150 N. End Road, Mountaintop, has been charged with DUI and purchase of alcoholic beverage by a minor. Officer Rachel Deluca of the Fairview Township Police Department filed the charges on March 6, 2018.

According to the Affidavit of Probable Cause, on March 6, 2018, Officer Deluca was dispatched to Bluestone Ave. and Greystone Dr. for a report of an assault. Officers were notified that the male stated he was assaulted by four peple at a house on Fieldstone Way and was hiding in a bush but the caller wanted to remain anonymous and refused EMS. Officer Deluca observed a female in the street on a cell phone. The female, Arden Morgans of 145 Fieldstone Way, stated Matthew Tirpak ran from her house after showing up intoxicated. She stated he smelled of alcoholic beverage and was acting erratically. She stated he was on foot and ran towards Greystone Drive.

Officer Zane of Rice Township located the male driving north on Greystone. Officer Zane stated Matthew was driving head on toward his cruiser. Matthew came to a stop along the drivers side of Officer Zane, at which time he exited his vehicle. Matthew stated he was assaulted by Roger Morgans at 145 Fieldstone Way. The officer observed front and rear end damage to the vehicle and Matthew stated he did not know what he hit. Matthew had the odor of alcoholic beverage on his breath and admitted to drinking two beers. Matthew was leaning against the rear of his vehicle due to unsteady gait. Matthew also had bloodshot, glassy eyes. Matthew was taken into custody on suspicion of driving under the influence of alcohol and placed into the officer’s cruiser. While Matthew was in the back of the cruiser, he began to hit his face off the divider prior to the officers after securing his seatbelt.

Matthew agreed to submit to a preliminary breath test. The second attempt showed a positive reading for the presence of alcohol. While speaking with Matthew, he stated several times that he wanted to die and wanted it (life) all over. He then stated multiple times for officers to shoot him. Officer Fromm of Wright Twp., sat in the back seat alongside Matthew during the transport to Wilkes-Barre General Hospital for a BAC and 302 commitment.

Officers then left the hospital and returned to Fieldstone Way to speak with Roger Morgans about the alleged assault. Roger stated that someone banged on his door, his wife opened it and it was Matthew Tirpak. Matthew went into the living room, sat next to Roger and asked for forgiveness for past issues. Matthew then went downstairs where others were for an semiformal sleep over. While downstairs, Matthew pushed Haley Dow at which time Roger was asked to tell Matthew to leave. Matthew began punching the basement floor and head butting the basement floor and the headbutted the basement door. All witnesses presnt stated Matthew was bleeding from the nose and had a mark on his eye. Matthew was then asked to leave at which time he began yelling “just shoot me” and “just kill me”.

The result of Matthew Tirpak’s BAC test was .082%.

A preliminary hearing has been scheduled April 19 at 9:30 a. m. before Magisterial District Judge Ferris Peter Webby Sr.
