DUI

Gregory Mikhalev, 24, 28 Senate Dr. Apt/Suite 10A,Mountaintop, has been charged with DUI. Charges were filed April 13, 2016 by Officer Kristen Paulshock of the Wright Township Police Department.

On Sunday, April 3, 2016, Officer Paulshock responded to a one-car motor vehicle accident in the area of 383 South Main Road, Wright Township. Upon arrival officer Paulshock found a 2001 Kia Rio sedan in the woods and down an embankment. The operator was identified as the defendant, Gregory Mikhalev. He was standing on the side of the road with the complainant who called 911. The complainant stated he was traveling south on SR2045 when he saw the vehicle in the woods, He stated that he stopped and saw the defendant exiting the vehicle.

The defendant admitted to driving the vehicle who was registered to him. He stated there were no other occupants. He stated he was traveling south on SR2045 from his apartment at 28 Senate Drive. He stated he was making a turn and ended up there. He said he had a lot of weight on the back of his car. He stated he was on his way to the Crossroads bar for drinks and friends. The officer asked him why he would not just travel on Church Road from his residence to the Crossroads and stated he was on Church Road.

The defendant had glossy eyes and an odor of alcoholic beverage on his breath. The officer asked him several times how much he had to drink and he denied drinking any alcoholic beverages. He denied using any illegal narcotics. He stated that he was not on any medications.

The officer advised him of the implied consent law and read him the O’Connell Warnings. He agreed to consent to a blood test and field sobriety tests which he performed poorly. He was asked again how much he had to drink. He stated that he had a drink. He then stated he had two drinks. The defendant stated that he had been wearing his seat belt and had no injuries. He refused medical treatment . He was transported to Geisinger Wyoming Valley. The results were found to be 0.17%

A preliminary hearing has been scheduled May 18, 2016 at 10 a. m. before Magisterial District Judge Ronald Swank.

Use/Possession ofDrug Paraphernalia

Richard Michael Seiwell, 21, 1645 Alberdeen Road, Mountaintop, has been charged with Use/Possession of Drug Paraphernalia. The charges were filed April 7, 2016 by Patrolman Kristen Paulshock of the Wright Township Police Department.

According to the Affidavit of Probable Cause, on Thursday, March 24, 2016, Ptlm. Paulshock was dispatched to the Kashuba residence at 201 Nuangola Road, Wright Township, for a 21-year old male overdose patient.

Upon arrival, the homeowner, Carol Kashuba, let police and EMS into the residence. She showed the patrolman where her grandson, Richard Michael Seiwell, was unresponsive on a bed in a bedroom by the front door. Seiwell’s skin was blue and his breathing was shallow. There was a hypodermic needle on the floor by Seiwell’s left foot. There was a spoon, a red lighter, a small blade and a box of Durex condoms on the nightstand next to the bed and next to the needle. The Durex box contained three condoms and six small wax paper bags. All items were taken as evidence. EMS revived Seiwell and transported him to Geisinger Wyoming Valley.

A preliminary hearing has been scheduled May 4, 2016 at 10 a. m. before Magisterial District Judge Ronald Swank.
