Bryan Jackson Vargas, 19, 70 Yorktown Road, Mountaintop, and Christopher Scott Fassari, 20, 23 Walden Drive, Mountaintop, have been charged with Use/Possession of Drug Paraphernalia and Possession of Marijuana by Ptlm. Kristen Paulshock of the Wright Township Police Department. Charges were filed on December 16, 2015.
According to the Affidavit of Probable Cause, on Tuesday, December 8, 2015 at 1:09 a. m., Ptlm. Paulshock was on routine patrol traveling east on Park Road in Wright Township when she noticed three vehicles in the municipal park near the basketball courts. Two of the vehicles were unoccupied. The third vehicle was occupied by three people. Wright Township Ordinance #84 states that no person shall remain on township property between the hours of 11 p. m. and dawn.
Ptlm. Paulshock pulled behind the third vehicle, a silver two-door Chevy Cavalier. She saw that there was a male in the driver seat, a male in the front passenger seat and a male in the rear passenger seat. Ptlm. Paulshock approached the passenger side door. The window was down approximately 3-4 inches. She immediately smelled a strong odor of marijuana coming from inside the vehicle. She asked the occupants for identification. She recognized the driver as a juvenile. She then identified the front passenger as Bryan Jackson Vargas and the rear passenger as Christopher Scott Fassari.
Rice Township Ptlm. Collotty responded. Ptlm. Paulshock asked the juvenile to exit the vehicle. She advised him that she could smell marijuana coming from his person and the vehicle. He admitted that he had just smoked marijuana and it belonged to all of them.
Vargas and Fassari then exited the vehicle. Vargas showed the officers that a clear plastic bag of suspected marijuana and pipe was between the passenger front seat where it was sitting and the center console. They had fallen down onto the floor of the rear passenger seat and were visible. These items were taken as evidence.
Ptlm. Collotty transported Fassari and Vargas to their residence. Ptlm. Paulshock transported the juvenile to his residence and released him to his mother.
The suspected marijuana was field tested and did test positive for marijuana.
A preliminary hearing has been scheduled for Vargas and Fassari on January 6, 2016 at 10:30 a. m. before Magisterial District Judge Ronald Swank.
Francis Joseph Maguire, 43, 74 Georges Road, Wapwallopen, has been charged with Aggravated Assault, Simple Assault, Recklessly Endangering Another Person and Harassment by PA State Tpr. Richard Williams, Hazleton Barracks. Charges were filed on December 24, 2015.
According to the Affidavit of Probable Cause, on December 23, 2015 at 4:34 p. m., Tpr. Andrew Morgantini and Tpr. Williams were dispatched to the area of 63 Dirt Lane in Dorrance Township for a report of an assault. Tpr. Williams arrived on the scene and made contact with Renee Lewis. Lewis related that she and her husband, Jerry Lewis, brought their young daughter to visit their neighbor, the Defendant, at 74 Georges Road, Wapwallopen, so that their daughter could give him Christmas ornaments she made for him as a gift.
When the Lewis family arrived at the Defendant’s residence, the Defendant walked outside with a baseball bat and struck Jerry Lewis with the baseball bat once in the head. The Defendant then shoved Jerry Lewis to the ground and began striking him repeatedly with a closed fist. When Renee Lewis tried to cover up Jerry Lewis and protect him, the Defendant struck her multiple times and subjected her to physical contact while trying to get through her to strike Jerry Lewis.
A preliminary hearing has been scheduled January 6, 2016 at 10 a. m. before Magisterial District Judge James M. Dixon.
