Mountaintop Man Charged With DUI, Assault By Vehicle

Erik J. Chupela, 22, of Mountaintop, was arrested and charged by Wright Twp. Police on July 2, 2014 for a motor vehicle accident that he allegedly caused on May 24, 2014 with drugs and alcohol in his system. The crash severely injured a Shavertown woman.

Chupela was charged with DUI General Impairment, DUI Controlled Substance, Aggravated Assault by Vehicle While DUI, Careless Driving, Driving At Safe Speed and Restraint System Violation. Chupela was arraigned by Magistrate Ronald Swank and Bail was set at $5000 unsecured.

According to the Affidavit of Probable Cause, Wright Twp. Ptlm. David Winsock was dispatched to a two-car accident on Church Road on May 24 at 10:54 p. m. Upon arrival at the scene, Ptlm. Winsock observed both vehicles involved in the accident had severe and disabling damage and both operators were still in their vehicles. Lisa Luksic of Shavertown, who was operating a Toyota 4Runner, was entrapped in the driver’s seat. Firefighters extricated her from the vehicle in order to provide her with medical treatment. The defendant was bleeding severely from his head and face. Both drivers were transported to the hospital for further treatment.

Ptlm. Winsock stated that while he was speaking to the defendant, later identified as Erik J. Chupela, 92 S. Mountain Blvd., Chupela was sitting in the passenger seat of a 2007 Toyota Camry that he admitted to operating and he was the only one in the vehicle. Chupela stated he was out at King’s Pizza and was on his way to meet friends. When asked by the officer if he had been drinking, Chupela stated,
